Last updated: Sunday, November 8. These Terms explain the rules for using Brooklyn.town (brooklyn.town). Please read them: by using the site, you agree to them.
1. About this template
This document is a general template prepared for Brooklyn.town. It is not legal advice and should be reviewed and adapted by a licensed attorney before the site launches.
2. Who we are
Brooklyn.town is a community portal for Brooklyn, New York, published by Metrosolus (https://metrosolus.com), referred to here as “we” or “us”. You can reach us at contact@brooklyn.town or by mail at the address given on our Contact page.
The site is offered in English, French and Spanish. If the translations differ, the English version is used to interpret these Terms.
3. Acceptance and eligibility
By browsing or using Brooklyn.town, you agree to these Terms, the Privacy Policy, the Posting & Community Rules and the Disclaimer. If you do not agree, please do not use the site.
Brooklyn.town is not directed to children under 13, and we do not knowingly collect their information. To post anything or to submit a form containing personal data, you must be at least 18 years old and able to enter into a binding agreement.
4. What Brooklyn.town is, and what it is not
Brooklyn.town lets visitors send feedback or complaints, publish Lost & Found notices, post gigs and classifieds, post and apply to jobs, register in a candidate database, list rooms or apartments for rent, and submit business listings or quote requests.
We are an online venue only. We are not an employer, a staffing or recruitment agency, a real-estate broker or agent, a marketplace or payment processor, or a party to any hire, rental, sale or other deal between users. We do not process payments for gigs or classifieds.
Any agreement is strictly between the people involved. We do not verify users, listings, employers, candidates or businesses, and we do not guarantee any outcome.
5. Your submissions
You are responsible for everything you submit, including text, photos and contact details. You promise that it is accurate, that you have the right to share it, and that it complies with the law and with our Posting & Community Rules.
Submissions are reviewed before they are published (moderation). We may lightly edit for clarity or safety, ask for changes, or decline to publish, without giving a reason. Review does not mean that we endorse or verify a submission.
6. Licence to your content
You keep ownership of your content. By submitting it, you give Metrosolus a non-exclusive, worldwide, royalty-free licence to host, display, reproduce, format and distribute it on Brooklyn.town (including in its three languages and on related pages) while it is published, and for a reasonable time afterward for backups and legal needs.
Private details, such as the contact information of non-anonymous submitters and candidate CVs, are not published under this licence. They are handled as described in the Privacy Policy.
7. Our role as an intermediary, and takedown requests
We host content created by users and act as an intermediary, not as the author or publisher of that content. To the fullest extent allowed by law, including Section 230 of the Communications Decency Act, we are not liable for what users post.
If you believe content on the site infringes your copyright or is otherwise unlawful, write to contact@brooklyn.town with: your name and contact details; the exact web address (URL) of the content; a description of your work or of the problem; a statement that you act in good faith; and, for copyright notices, a statement under penalty of perjury that your notice is accurate and that you own or represent the rights holder (as described in the DMCA).
We review notices promptly and may remove content and notify the person who posted it. Repeat infringers may lose access to the site.
8. Acceptable use, removal and termination
Do not misuse the site: no spam, no scraping for resale, no harvesting of other people's contact details, no hacking or overloading, no impersonation, and no attempts to bypass moderation. Your content must respect our Posting & Community Rules.
We may remove content, refuse a submission, block an IP address or end access at any time, with or without notice, if we believe these Terms or the law are being violated, or to protect users or the site.
You can ask us to delete your content or data at any time by writing to contact@brooklyn.town. Provisions that by their nature should continue (such as the licence for backups, disclaimers, limitation of liability, indemnity and governing law) survive termination.
9. Links and dealings between users
The site may link to third-party websites and services. We do not control them and are not responsible for their content, security or policies.
You deal with other users at your own risk. Please follow the safety tips in our Posting & Community Rules and read the Disclaimer. Employers, landlords and businesses remain solely responsible for complying with employment, housing, tax and licensing laws.
10. No warranties, and limit of liability
Brooklyn.town is provided “as is” and “as available”. We do not promise that it will be error-free, uninterrupted or secure, or that content is accurate, complete or current.
To the fullest extent permitted by law, Metrosolus and its owners, staff and contractors are not liable for indirect, incidental, special or consequential damages, for loss of income, data, opportunity or reputation, or for anything arising from user content or from dealings between users. Our total liability for any claim relating to the site is limited to [US$100].
Some laws do not allow certain limits, so parts of this section may not apply to you. Nothing here limits liability that cannot legally be limited.
11. Indemnity
If your content or your use of the site breaks these Terms or the law, or harms someone else, and this leads to a claim against us, you agree to cover the reasonable costs and losses that result (including reasonable attorney fees), to the extent allowed by law.
12. Governing law and disputes
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules.
Any dispute that cannot be settled informally will be brought exclusively in the state or federal courts located in Kings County (Brooklyn), New York, and you consent to their jurisdiction. Before filing, please contact us at contact@brooklyn.town so that we can try to resolve the matter in good faith.
13. Changes and contact
We may update these Terms from time to time. The date at the top shows the latest version. If you keep using the site after a change, you accept the new Terms; for major changes we will try to post a notice on the site.
If any part of these Terms is found unenforceable, the rest stays in effect. Not enforcing a rule on one occasion does not mean we give it up.
